1. Introduction

Welcome to GrantEater.ai, an AI-powered grant writing assistant provided by GrantEater.ai LLC (“GrantEater.ai,” “we,” “us,” or “our”). GrantEater.ai LLC is a company based in Portland, Oregon, USA (Multnomah County). These Terms of Service (“Terms”) govern your access to and use of the GrantEater.ai website, application, and services (collectively, the “Service”). By creating an account or using our Service, you (“User” or “you”) agree to be bound by these Terms. If you do not agree, you must not use the Service. This is a legally binding agreement between you and GrantEater.ai. Please read it carefully.

2. Eligibility

You must be at least 18 years old to use the Service. The Service is intended for adult use only and is not available to individuals under 18. By registering an account, you affirm that you are 18 or older and capable of entering into a legal agreement. We may require you to confirm your age during sign-up (for example, by an explicit affirmation checkbox). You also represent that all information you submit is truthful and accurate, and that your use of the Service will comply with all applicable laws and regulations.

3. Account Registration and Security

To access the Service, you must create an account by providing a valid email address and a secure password. You may also be asked for your name and information about your nonprofit context (such as your organization or role) during onboarding to tailor your experience. In the future, we may offer alternative sign-in methods (such as OAuth with third-party providers), but the same Terms will apply. Please note:

  • Account Information: You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
  • Account Security: You are responsible for maintaining the confidentiality of your password and for restricting access to your account. Do not share your login credentials. You agree to notify us immediately at [email protected] of any unauthorized use of your account or any security breach.
  • Responsibility for Account Activity: You are liable for all activities that occur under your account, whether or not you authorized them. GrantEater.ai will not be liable for any loss or damage arising from unauthorized use of your account, but you may be held responsible for losses incurred by us or others due to such unauthorized use.

4. Subscription Plans, Fees, and Payments

4.1 Free Trial and Subscription Billing

GrantEater.ai offers a 30-day free trial for new users. After the free trial period ends, continued access to the Service requires a paid subscription. By signing up for the Service, you agree that if you do not cancel before the trial ends, your account will automatically transition to a paid subscription and your provided payment method will be charged. The standard subscription fee is $12 USD per month (unless otherwise indicated at the time of signup or in promotional offers). New members receive a 30-day free trial before the first charge.

  • Free Trial: New subscribers receive a 30-day free trial period. During this trial, you will have full access to the Service features. At the end of the trial period, you will be automatically charged $12 (plus any applicable taxes) unless you cancel your subscription before the trial ends.
  • Auto-Renewal: All subscriptions automatically renew on a monthly basis. This means you will be charged $12 (plus any applicable taxes) at the end of each monthly billing cycle until you cancel. We will bill the monthly subscription fee to the payment method you provide, via our third-party payment processor.
  • Add-On Credits: In addition to the base subscription, you may purchase optional credit packages to enhance or extend Service usage. The available packages are: $10 for 250 credits, $20 for 500 credits, or $50 for unlimited credits. (These credits may correspond to additional AI usage or features, as described on our site.) Add-on credit purchases are one-time charges and are not recurring unless you initiate another purchase.

4.2 Payment Processing

All payments are processed securely through Stripe, our third-party payment provider. GrantEater.ai does not store your full credit card or payment account information on our servers. Your payment details are handled by Stripe, and their use of your data is governed by their privacy policy. By providing a payment method, you represent that you are authorized to use that payment method and you authorize Stripe to charge the subscription and any add-on fees to it.

  • Billing Information: You must provide current, complete, and accurate billing information. If your payment method is declined or fails, we may suspend or terminate your access to the Service. You must update your payment information promptly if it changes (e.g., card expiration or billing address change).
  • Taxes: Subscription fees do not include any taxes (such as sales, use, VAT, or other taxes). You are responsible for any applicable taxes, and we will charge tax when required to do so by law.

4.3 Cancellation and Refunds

  • Cancellation: You may cancel your subscription at any time through the billing/settings section of your account. Cancellation will prevent future billing but will not retroactively refund the current period. After cancellation, you will continue to have access to the Service until the end of your current paid month (or trial, if you cancel during the trial). Your subscription will not renew thereafter.
  • End of Service Access: If you cancel or your subscription lapses, your account may revert to a limited free status or be disabled. We reserve the right to delete or restrict access to your saved content after a period of inactivity following a cancellation (we will attempt to notify you before any data deletion – see the Privacy Policy for data retention details).
  • Refunds: As a general policy, subscription fees and credit purchases are non-refundable. However, we want you to be satisfied. If you believe there was an error in billing or you had an extraordinary issue, you may request a refund by contacting us via the billing section or at [email protected]. Refund requests will be evaluated on a case-by-case basis at our discretion. For example, if a technical problem on our side seriously affected your use of the Service, we may provide a prorated refund or credit. We do not provide refunds for unused portions of your subscription term or unused add-on credits, except where required by law.

4.4 Changes to Fees

Our pricing and fee structure may change over time. Any change in subscription price or credit package pricing will be communicated to you in advance (for example, via email or through the Service). Fee changes will not apply retroactively and, if applicable, will take effect at the start of your next billing cycle following the notice. If you do not agree to a fee change, you may cancel your subscription before the new fee takes effect. Continued use of the Service after the price change becomes effective constitutes your agreement to pay the updated amount.

5. User Content Ownership and License

5.1 User Content Definition

In the context of these Terms, “User Content” means any text, information, data, or materials that you input into the Service or that are generated for you by the Service's AI based on your input. This includes, for example, grant proposal drafts, textual content, project descriptions, or any other material you submit or create while using GrantEater.ai.

5.2 Ownership of Your Content

You retain full ownership of all User Content that you create or upload to GrantEater.ai. GrantEater.ai does not claim any ownership rights in your User Content. Subject to the limited license granted to us below, you have the right to use, edit, publish, disclose, or distribute your User Content as you see fit. We do not and will not sell your User Content or make it publicly available to others without your consent.

5.3 License to GrantEater.ai

In order to operate and improve our Service, we need certain permissions from you to handle your content. By using the Service, you grant GrantEater.ai LLC a non-exclusive, worldwide, royalty-free, limited license to host, store, transmit, and display your User Content solely for the following purposes:

  • Providing the Service: We will use and display your content as needed to fulfill the core functionality of the Service — for example, to feed your input to our AI model (operated by OpenAI) and return AI-generated grant writing suggestions to you, or to save your drafts and allow you to access them when you log in.
  • Private Display: Your User Content will only be displayed or made available to you (and those you explicitly share it with, if sharing features exist). We will not expose your private content to other users or the public without your direction.
  • Anonymized Improvement: You agree that GrantEater.ai may anonymize or aggregate your User Content (removing personal identifiers like names or specific organizational details) and use these anonymized data for internal purposes such as improving our AI models, algorithms, and services. This might include machine learning training, quality assurance, and analytics to make the Service better for users.
  • Backup and Legal Compliance: We may also keep copies of your content for backup and archival purposes, and to comply with any legal obligations (such as a valid subpoena or court order).

This license is not exclusive (meaning you can grant others the right to use your content as well), and it is fully revocable if you delete your content or account (except to the extent your content has been shared with others via the Service, or if it has been anonymized and included in aggregate improvements, or needs to be retained for legal reasons as described in our Privacy Policy). Upon deletion of content or account, we will cease any further active use of the content, but you acknowledge that caching or backups of content may not be immediately purged.

5.4 No Public Use or Sale of Content

We understand that the content you create with GrantEater.ai is private and often sensitive (e.g., draft grant proposals for your organization). GrantEater.ai will not publicly display, publish, or share your User Content without your explicit consent. We also will not sell or rent your User Content to any third party. The only parties who may process your content are our service providers (such as our AI engine provider, currently OpenAI, which processes text to generate results) and only for the purposes of operating the Service as described. All such providers are bound by confidentiality and security obligations (see the Privacy Policy for more details on data sharing).

5.5 User Content Responsibilities

You are solely responsible for all User Content that you create, upload, or otherwise make available via the Service. This means:

  • Accuracy and Legality: You represent and warrant that you have the necessary rights to submit the User Content to the Service and that doing so will not violate any laws or infringe any third-party rights (including intellectual property or confidentiality obligations). For example, if you include text or data from an external source, you must have the right to use it.
  • No Sensitive Personal Data: You should avoid uploading extremely sensitive personal information (such as social security numbers, credit card numbers, health information, etc.) into grant drafts or other content on the platform, unless necessary, as our Service is primarily for grant writing content and not a secure storage for sensitive personal data. (See Privacy Policy for what data we collect and how we protect it.)
  • Backup Your Content: While we strive to maintain reliable storage, you are encouraged to keep backups of your important content externally. We are not responsible for loss of content (to the extent permitted by law), and the license you grant does not turn us into a guaranteed data repository.
  • Removal of Content: We reserve the right (though not the obligation) to remove or delete any User Content that we believe violates these Terms (for example, illegal content or content that violates the Acceptable Use Policy in Section 6) or that is otherwise objectionable, with or without notice. However, we do not routinely monitor private content, and generally will only review it if there's a suspicion of misuse or a specific issue.

6. Acceptable Use Policy

When using GrantEater.ai, you agree to adhere to the following rules and not misuse the Service. Prohibited conduct includes, but is not limited to, the following:

  • Illegal Activities: Do not use the Service for any unlawful purpose or in furtherance of illegal activities. You agree not to upload, generate, or otherwise use the Service to create content that violates any applicable law or regulations. This includes (but is not limited to) content that is fraudulent, defamatory, or that encourages illegal activity.
  • Hate Speech and Harassment: GrantEater.ai is dedicated to providing a positive, inclusive tool for users. You may not use the Service to generate or disseminate content that is hateful, threatening, or harassing toward any individual or group. This includes content that attacks or demeans someone on the basis of race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or any other characteristic that is protected by law.
  • Abusive or Malicious Content: You must not use the Service to produce content that is abusive, excessively violent, graphic, or otherwise inappropriate. Additionally, do not use the Service to bully, stalk, or harm others, or to create malware, spam, phishing content, or any content intended to deceive or cause harm.
  • Intellectual Property Infringement: Do not use the Service to upload or generate content that infringes the copyrights, trademarks, or other intellectual property rights of others. If you use excerpts or data from third-party sources in your grant proposals, you must have permission or a legal right to do so. You also should not mislead the AI to produce large verbatim texts from copyrighted sources.
  • Interference with the Service: You agree not to interfere with or disrupt the Service or servers/networks connected to the Service. This includes not attempting to hack, overload (“DDOS”), or reverse engineer any part of our platform or to circumvent any access controls or usage limits.
  • Automated Use: You will not launch or use any automated system (like bots, scrapers, or scripts) to access the Service or extract data, except with our prior consent. The Service is meant for interactive use by human end-users.
  • Impersonation and Misrepresentation: Do not impersonate any person or entity or misrepresent your affiliation. You should not imply that the content generated by GrantEater.ai is endorsed or approved by any organization or expert if that's not the case. (For example, if you use the Service to draft a grant proposal, you must review it yourself – do not falsely claim it was written by a professional grant writer or an official of your organization.)
  • Service Integrity: Do not use the Service in a way that could damage, disable, or impair the Service (e.g., introducing viruses or harmful code). Do not attempt to access other users' accounts or data.

GrantEater.ai reserves the right to monitor usage, investigate any suspected breach of this Acceptable Use Policy, and take appropriate action, which may include suspension or termination of your account (see Section 8), and if necessary, reporting to law enforcement.
